Terms & Agreement
1. Booking & Payment
All sessions must be paid in full on or before the session date.
To reserve your date and time, a non-refundable booking fee is required:
$250–$1000 or 50% of the total session cost, depending on the session type.
If the booking fee is not received within 24 hours, your session date and time will be released.
For weddings: A non-refundable booking fee of $850 confirms your date.
50% due half way to date
Remaining balance is due two weeks prior to the wedding.
For family, newborn, maternity, and business sessions: Remaining balance is due the day of the session.
Payment may be made via cash, check, or Venmo.
All goods, images, and files remain the property of Katherine Elaine Photography until paid for in full.
2. Cancellation & Rescheduling
All booking fees are non-refundable.
If a session is canceled (including same-day cancellations), any funds beyond the booking fee may be applied as a credit toward a future session within 6 months of the original date.
It is the client’s responsibility to contact the photographer to reschedule within this timeframe.
For business sessions and weddings, cancellations are subject to the following:
More than 14 business days before the event: booking fee is forfeited.
Within 14 business days of the event: full payment for contracted services is required.
Clients are encouraged to obtain event insurance to cover potential cancellation costs.
3. Copyright & Usage Rights
All images remain the copyright and intellectual property of Katherine Elaine Photography under the Copyright, Designs, and Patents Acts.
Clients receive edited digital images for personal, non-commercial use only.
Katherine Elaine Photography retains the right to use images for advertising, marketing, website display, social media, print materials, and publication.
Images may be cropped, edited, combined with text or graphics, and used in composite works.
Clients waive any right to approve or review final images before use.
If you prefer that no images be shared publicly, you may indicate this by checking the “Do Not Share” box on your contract or notifying the photographer directly.
4. Model Release
For good and valuable consideration, the client (the “Model”) grants Katherine Elaine Photography and its assigns permission to use, license, reproduce, and distribute images in any media (digital, print, film, television, etc.) for lawful purposes including advertising, promotion, and marketing.
The Model agrees that all rights to the images belong solely to Katherine Elaine Photography.
The Model waives any right to compensation, royalties, or future claims related to image use.
This release is irrevocable, worldwide, and perpetual, governed by the laws of California.
The Model releases and holds harmless Katherine Elaine Photography, its representatives, employees, and any assigns from all liability, including claims for alteration, distortion, or misuse.
If the Model is a minor, the parent or legal guardian grants consent on their behalf, confirming full authority to execute this release.
Definitions:
Model — the individual photographed.
Media — any current or future medium, including print, digital, film, and broadcast.
Assigns — any person or entity granted rights by the photographer.
Images — all photographs or recordings created during the session.
Consideration — value received in exchange for rights granted.
Shoot — the photographic or film session described herein.
5. Image Storage & Retrieval
Images are stored and available for free download for 60 days after delivery.
After 60 days, images will be archived for up to one year from the date of the session.
A $100 re-download fee will apply to retrieve and resend images after the initial 60-day window.
Two reminder emails will be sent 14 days and 5 days before the gallery expires.
6. Creative License & Limitations
Photographic style, lighting, and composition are at the photographer’s discretion. Every effort will be made to accommodate client requests, but no specific image or pose is guaranteed.
Outdoor sessions are subject to weather and location conditions, which shall not be grounds for complaint or refund.
Venue and officiant restrictions may limit photography coverage; Katherine Elaine Photography is not responsible for obstructed views or limited access.
While equipment is regularly checked and maintained, the photographer is not liable for images lost due to technical failure or unforeseen circumstances.
7. Force Majeure
In the rare event that the photographer cannot attend or complete services due to illness, accident, or circumstances beyond control (e.g., natural disaster, traffic, theft), liability is limited to a full refund of fees paid. The photographer will make reasonable efforts to arrange a replacement photographer when possible.
8. Wedding Day Coverage
Katherine Elaine Photography is the sole professional photographer for contracted weddings. Guests are encouraged to take personal photos but may not interfere with professional work.
The photographer may take a break during dinner or the reception; a meal is appreciated but not required.
Coverage typically includes all scheduled events through the first dance. Additional coverage beyond this time must be arranged in advance.
9. Personal Liability
All directions given during photo sessions are followed at the participant’s own risk. Katherine Elaine Photography assumes no responsibility for injury, property damage, or personal accidents occurring during any session.
10. Delivery Timeline
Final edited digital images are typically delivered within 4–6 weeks, depending on the season and workload.
11. Curbside Photo Sessions
Images from curbside photo sessions may be included in promotional materials or printed in a tabletop book for display and marketing purposes.
